Health, Safety, Security and Environmental(HSSE) Policy Statement

EMD Chemicals Inc. (EMD), recognizes its responsibilities to environmental protection and conservation as well as for the occupational health, safety and security of its associates and its assets. EMD is committed to achieving excellence in all its business practices with respect to HSSE in full compliance with the prevailing laws of the USA, in association with the HSSE standards of the Merck KGaA Group and the Guiding Principles of Responsible Care®. HSSE improvement requires vigilance by all management personnel and is a priority for every associate at EMD.<.p>

EMD will:

• Comply with all Federal, State and local laws and regulations and other HSSE requirements to which EMD subscribes.
• Develop procedures, reporting systems and monitoring systems whose intent are to prevent pollution, conserve natural resources, reduce waste, improve the environment and protect the health, safety and security of associates.
• Minimize the public disposal of waste products through reduced material consumption and recycling efforts, and ensure waste products are handled, treated and disposed of in accordance with prevailing law, environmentally sound principles and good business practices.
• Conduct regular audits and management review to ensure all HSSE activities are carried out in accordance with this policy.
• Provide appropriate training and support to all associates to ensure HSSE objectives and targets are realized on a permanent basis.
• Ensure that contractors, subcontractors, suppliers and customers are aware of EMD's HSSE policy and practices and the crucial role that HSSE plays in EMD's business decisions.
• Ensure that this HSSE policy is made readily available to associates and other interested parties.
• Ensure necessary and reasonable resources are made available to achieve the HSSE objectives and to make continual improvement to protect the interests of EMD, its associates and the environment.
• Incorporate appropriate Health, Safety, Security and Environmental criteria and factors into business decisions.
